Reporting copyright infringement

BarHookups is a nightlife discovery service. Members can submit reviews, venue recommendations, venue details and events, and we host that content on our service.

This policy explains how a copyright owner, or someone authorised to act for them, can tell us about material they believe infringes their copyright, and how a member can respond if material they posted is removed. We handle these notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

Sending a copyright infringement notice

Send your notice to our designated agent, using the contact details at the top of this page. Email is the quickest route; you can also write to the postal address. A notice must be in writing and must include all of the following, as required by 17 U.S.C. § 512(c)(3):

  • Your physical or electronic signature — the signature of the copyright owner, or of a person authorised to act on their behalf.
  • Identification of the copyrighted work you say has been infringed. If one notice covers several works at the same site, a representative list of those works is enough.
  • Identification of the material you say is infringing, and information reasonably sufficient for us to find it. The web address of the page is the most useful thing you can give us.
  • Your contact details: name, mailing address, telephone number and email address.
  • A statement that you have a good-faith belief the use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf.

A notice that does not include all of these elements may not be effective. Under 17 U.S.C. § 512(f), a person who knowingly makes a material misrepresentation in a notice — for example, claiming that material infringes when it does not — may be liable for the damages that result, including the other party's costs and legal fees.

What happens when we receive a notice

We review every notice we receive and remove or disable access to material that qualifies, usually promptly. We then tell the member who posted it and give them a copy of the notice, so they have the chance to respond.

We may contact you if we need more information to identify the material. Where a notice is incomplete, or where the material plainly does not infringe, we may decline to remove it and explain why.

We keep a record of the notices we receive and the action we take on them.

If your material was removed: counter-notification

If we removed or disabled material you posted and you believe that was a mistake, or that the material was misidentified, you can send us a counter-notice under 17 U.S.C. § 512(g). Send it in writing to our designated agent, using the contact details at the top of this page, and include all of the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled, and where it appeared before we removed it.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled by mistake or misidentification.
  • Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located — or, if you are outside the United States, any judicial district in which we may be found — and that you will accept service of process from the person who sent the original notice, or from their agent.

When we receive a counter-notice that includes all of these elements, we forward it to the person who sent the original notice, with a copy to you. Unless that person tells us within 10 to 14 business days that they have filed a court action seeking an order to restrain the material, we restore the material or re-enable access to it, usually within that same period.

A counter-notice is a statement made under penalty of perjury. Under 17 U.S.C. § 512(f), a knowing misrepresentation in one may make you liable for the damages that result, including the other party's costs and legal fees.

Repeat infringers

We close the accounts of members who repeatedly infringe copyright, in appropriate circumstances, and we may remove or disable access to their content at the same time.

We take into account the notices we receive, any counter-notices, and the outcome of any court action. We may act on our own records even where no court has made a finding of infringement.

Registration reference

Our designated agent is registered with the U.S. Copyright Office under registration number DMCA-1083590, and the registration is current.

That number identifies our agent designation in the Copyright Office's public directory. It is reference information only: it is not proof that we own any copyright, and it does not indicate approval, endorsement or review by the U.S. Copyright Office or by any other government agency.

A designation remains in effect for three years and is renewed before it expires.
